1. Introduction
Welcome to Opins. These Terms of Service ("Terms") govern your access to and use of the Opins mobile application, website, matching assistant, and related services (collectively, the "Platform") operated by Opins, along with its founders ("Founders"), directors, affiliates, and representatives (collectively, "Company", "Opins", "we", "us", or "our").
By downloading, registering, browsing, or utilizing any services on the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all access and use of the Platform.
Intermediary Status Notification: Opins operates as an electronic intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000, and seeks the protection available to intermediaries under Section 79 of the Information Technology Act, 2000, subject to compliance with applicable law, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time.
Opins provides a technology platform that facilitates connections between employers and workers. Opins does not create, control, supervise, or guarantee any employment relationship or transaction between users. Subject to applicable law, Opins is not responsible for user-generated content, job postings, worker profiles, communications, or agreements entered into between users.
Opins may perform limited verification where applicable, but does not guarantee the identity, qualifications, suitability or conduct of any user. While Opins may conduct limited verification of user identities, contact details, or other information at its sole discretion, Opins does not guarantee the identity, qualifications, experience, skills, suitability, legality, or conduct of any Employer or Worker. Users are solely responsible for conducting their own due diligence before entering into any employment or service relationship through the Platform.
Opins is not liable for any misrepresentation, false information, fraudulent conduct, or breach of obligations by any user of the Platform.
2. User Eligibility
To register for an account and use the Platform, you must represent and warrant that you meet the following eligibility criteria:
- Be a citizen of India or legally authorized to reside and work in India.
- Be at least 18 years of age and possess the legal capacity to enter into binding contract agreements under the Indian Contract Act, 1872.
- For Workers: Hold valid government-issued identification cards (including Aadhaar, PAN, Voter ID, or Driving License), and possess all necessary skills, qualifications, permits, or licenses required to perform work in your selected categories.
- For Employers/Businesses: Be a legally registered business entity, sole proprietorship, partnership, LLP, or corporation in good standing in India, possessing valid tax and operational registrations (including GSTIN, MSME, or Shop and Establishment licenses) as applicable.
3. Job Matching
Opins is India's instant hiring platform, providing the fastest way to connect people looking for work with employers. We provide the technology, including an intelligent assistant that processes matches in your local language, to link businesses with skill-verified workers nearby. You acknowledge and agree to the following:
- No Employment Relationship: Opins is not an employer, employment agency, labor contractor, or subcontractor. Workers matched on the platform are independent service providers and not employees, agents, or joint-venturers of Opins or its Founders. There is no contract of employment between Opins and any user.
- Employer Responsibility: Employers are solely responsible for detailing shift tasks, requirements, hours, compensation, and workplace safety guidelines. Employers must verify worker identities and check references before hiring.
- Job Seeker Responsibility: Job seekers are responsible for communicating honestly with employers, showing up as agreed, and conducting themselves professionally during interviews and work.
- No Guarantee: Opins does not verify, screen, or guarantee the capabilities, reliability, safety, legal status, or character of any worker or employer. All matches and interactions are carried out at your own risk.
4. Charges & Subscriptions
Opins does not process, hold, or transfer wages between employers and workers. All wage payments are agreed and settled directly between the employer and the worker, entirely outside the Platform. Opins is not a party to, and bears no responsibility for, any wage payment, dispute, delay, or non-payment between users.
What Opins charges for:
- Job Seekers: Free to browse and apply to up to 15 jobs. Continued access beyond 15 applications requires a paid subscription (₹99 for 2 months, or ₹149 for 3 months with AI Auto-Apply). See our Pricing page for current rates.
- Employers: Free to post jobs and chat with candidates on the Basic plan. An optional Premium subscription (₹999/month) offers unlimited job postings and priority visibility. One-time "Boost" purchases (₹199) are also available to increase a single job post's visibility for a limited period.
All subscription and boost payments are processed through licensed third-party payment gateways compliant with RBI regulations. Opins does not store your card or payment details.
Subscriptions auto-renew unless cancelled before the renewal date. You can cancel anytime from your account settings; cancellation stops future renewals but does not refund the current active period except as described in our Refund Policy.
5. Prohibited Conduct
To ensure a safe, reliable, and fair environment on Opins, users agree NOT to engage in any of the following prohibited behaviors:
- Circumvention: Bypassing the Platform's payment mechanism, escrow flow, or matching system to coordinate work or payments directly to avoid platform fees.
- Fraudulent Credentials: Registering with fake, altered, or stolen government IDs, credentials, GSTINs, or impersonating any other person or business entity.
- Harassment & Misconduct: Threatening, harassing, abusing, or discriminating against other users on the basis of gender, caste, religion, or region via in-app chats, calls, or during shifts.
Intellectual Property: All intellectual property rights in and to the Platform, including its software, source code, design, user interface, logos, trademarks, trade names, graphics, text, databases, features, and other content, are owned by or licensed to Opins and are protected under applicable intellectual property laws.
Except as expressly permitted by Opins, users shall not copy, reproduce, modify, distribute, publish, sell, license, reverse engineer, decompile, create derivative works from, or otherwise exploit any part of the Platform or its content without prior written consent.
Any feedback, suggestions, ideas, or recommendations submitted by users regarding the Platform may be used by Opins without any obligation to compensate or acknowledge the user.
Account Suspension and Termination: Opins reserves the right, at its sole discretion, to suspend, restrict, deactivate, or permanently terminate any user account, remove any content, or deny access to the Platform without prior notice if:
- the user violates these Terms or any applicable policies;
- the user provides false, misleading, or fraudulent information;
- the user engages in illegal, abusive, fraudulent, or harmful activities;
- the user infringes the rights of any third party;
- such action is required to comply with applicable law, a court order, or a government authority; or
- Opins reasonably believes the user's activities may harm the Platform, its users, or its reputation.
Upon termination, the user's right to access and use the Platform shall immediately cease. Any provisions of these Terms that by their nature are intended to survive termination, including limitation of liability, indemnity, dispute resolution, intellectual property, and governing law, shall continue to remain in effect.
6. Limitation of Liability & Indemnification
Limitation of Liability: To the maximum extent permitted by applicable law, Opins, its founders, directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to the use of the Platform.
Opins' total liability for any claim arising out of or relating to these Terms or the use of the Platform shall not exceed the amount paid by the user to Opins, if any, during the six (6) months immediately preceding the event giving rise to the claim.
Nothing in these Terms shall exclude or limit liability for fraud, wilful misconduct, or any liability that cannot be excluded or limited under applicable law.
Intermediary Safe Harbor: Users acknowledge that Opins functions as an intermediary under the IT Act, 2000. All interactions, shifts, and agreements are solely between the respective worker and employer.
Indemnification: You agree to defend, indemnify, and hold harmless Opins, its Founders, Directors, Officers, Employees, and Affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from your breach of these Terms, your interactions or disputes with other users, or your violation of any local laws (including labor, minimum wage, tax, or intellectual property laws in India). By creating an account or using Opins, you freely, specifically, and unconditionally consent to the collection, processing, storage, and sharing of your personal data for the purposes described in this Privacy Policy. You may withdraw your consent at any time, subject to applicable law.
Governing Law & Jurisdiction: These Terms and any dispute arising out of your use of the Platform shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.
User-Generated Content: Users retain ownership of the content they upload, submit, or post on the Platform, including resumes, profile information, job postings, company details, photographs, logos, reviews, and other materials ("User Content").
By uploading or submitting User Content, the user grants Opins a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, process, modify (for formatting purposes only), distribute, and use such User Content solely for the purpose of operating, maintaining, improving, promoting, and providing the Platform's services.
The user represents and warrants that they own or have all necessary rights, permissions, and authority to upload the User Content and that such content does not infringe the rights of any third party or violate any applicable law.
Opins reserves the right to remove or disable access to any User Content that violates these Terms or applicable law.
AI-Powered Features Disclaimer: Opins may use artificial intelligence (AI), machine learning, or automated algorithms to provide job recommendations, worker matches, profile suggestions, or other Platform features. These recommendations are generated automatically and are provided for informational and convenience purposes only.
Opins does not guarantee the accuracy, completeness, suitability, or success of any AI-generated recommendation, match, or suggestion. Users are solely responsible for evaluating and verifying the suitability of any Worker, Employer, job opportunity, or service before entering into any employment or service relationship.
Opins shall not be liable for any decisions, actions, losses, or damages arising from reliance on AI-generated recommendations or automated features.
