1. Introduction
Welcome to Opins. These Terms of Service ("Terms") govern your access to and use of the Opins mobile application, website, matching assistant, and related services (collectively, the "Platform") operated by Opins, along with its founders ("Founders"), directors, affiliates, and representatives (collectively, "Company", "Opins", "we", "us", or "our").
By downloading, registering, browsing, or utilizing any services on the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all access and use of the Platform.
Intermediary Status Notification: You acknowledge that Opins operates solely as an electronic intermediary matching platform under Section 2(1)(w) of the Information Technology Act, 2000 (India). As such, the Company and its Founders are not responsible for, do not curate, and exclude all liability for user-generated content, job postings, worker profiles, credentials, ratings, or any communications between users.
2. User Eligibility
To register for an account and use the Platform, you must represent and warrant that you meet the following eligibility criteria:
- Be a citizen of India or legally authorized to reside and work in India.
- Be at least 18 years of age and possess the legal capacity to enter into binding contract agreements under the Indian Contract Act, 1872.
- For Workers: Hold valid government-issued identification cards (including Aadhaar, PAN, Voter ID, or Driving License), and possess all necessary skills, qualifications, permits, or licenses required to perform work in your selected categories.
- For Employers/Businesses: Be a legally registered business entity, sole proprietorship, partnership, LLP, or corporation in good standing in India, possessing valid tax and operational registrations (including GSTIN, MSME, or Shop and Establishment licenses) as applicable.
3. Job Matching
Opins is India's instant hiring platform, providing the fastest way to connect people looking for work with employers. We provide the technology, including an intelligent assistant that processes matches in your local language, to link businesses with skill-verified workers nearby. You acknowledge and agree to the following:
- No Employment Relationship: Opins is not an employer, employment agency, labor contractor, or subcontractor. Workers matched on the platform are independent service providers and not employees, agents, or joint-venturers of Opins or its Founders. There is no contract of employment between Opins and any user.
- Employer Responsibility: Employers are solely responsible for detailing shift tasks, requirements, hours, compensation, and workplace safety guidelines. Employers must verify worker identities and check references before hiring.
- Job Seeker Responsibility: Job seekers are responsible for communicating honestly with employers, showing up as agreed, and conducting themselves professionally during interviews and work.
- No Guarantee: Opins does not verify, screen, or guarantee the capabilities, reliability, safety, legal status, or character of any worker or employer. All matches and interactions are carried out at your own risk.
4. Charges & Subscriptions
Opins does not process, hold, or transfer wages between employers and workers. All wage payments are agreed and settled directly between the employer and the worker, entirely outside the Platform. Opins is not a party to, and bears no responsibility for, any wage payment, dispute, delay, or non-payment between users.
What Opins charges for:
- Job Seekers: Free to browse and apply to up to 15 jobs. Continued access beyond 15 applications requires a paid subscription (₹99 for 2 months, or ₹149 for 3 months with AI Auto-Apply). See our Pricing page for current rates.
- Employers: Free to post jobs and chat with candidates on the Basic plan. An optional Premium subscription (₹499/month) offers unlimited job postings and priority visibility. One-time "Boost" purchases (₹99) are also available to increase a single job post's visibility for a limited period.
All subscription and boost payments are processed through licensed third-party payment gateways compliant with RBI regulations. Opins does not store your card or payment details.
Subscriptions auto-renew unless cancelled before the renewal date. You can cancel anytime from your account settings; cancellation stops future renewals but does not refund the current active period except as described in our Refund Policy.
5. Prohibited Conduct
To ensure a safe, reliable, and fair environment on Opins, users agree NOT to engage in any of the following prohibited behaviors:
- Circumvention: Bypassing the Platform's payment mechanism, escrow flow, or matching system to coordinate work or payments directly to avoid platform fees.
- Fraudulent Credentials: Registering with fake, altered, or stolen government IDs, credentials, GSTINs, or impersonating any other person or business entity.
- No-Shows & Cancellations: Repeatedly failing to show up for accepted shifts without reasonable, timely notice (which will result in instant account suspension or termination).
- Harassment & Misconduct: Threatening, harassing, abusing, or discriminating against other users on the basis of gender, caste, religion, or region via in-app chats, calls, or during shifts.
- Intellectual Property & System Abuse: Reverse-engineering, scraping, spamming, or disrupting the matching assistant, software algorithms, or server infrastructure of the Platform.
6. Limitation of Liability & Indemnification
Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Opins, its Founders, Directors, Officers, Employees, or Affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, losses arising from body injury, accidents, health hazards, property damage, death, loss of wages, business interruption, or disputes between workers and employers occurring during or in connection with any shift or match.
Intermediary Safe Harbor: Users acknowledge that Opins functions as an intermediary under the IT Act, 2000. All interactions, shifts, and agreements are solely between the respective worker and employer.
Indemnification: You agree to defend, indemnify, and hold harmless Opins, its Founders, Directors, Officers, Employees, and Affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from your breach of these Terms, your interactions or disputes with other users, or your violation of any local laws (including labor, minimum wage, tax, or intellectual property laws in India).
Governing Law & Jurisdiction: These Terms and any dispute arising out of your use of the Platform shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.
